www.vistaholidayhomes.com and www.vistarural.es (hereafter referred to as "vistarural.com") are owned and run by Adam Hayes NIE X2247381-M (hereafter referred to as "the site owner").

Legal jurisdiction

Terms and conditions are governed by Spanish law and users and advertisers on "vistarural.com" accept the exclusive jurisdiction of Spanish courts in the city of Granada.

A condition of using "vistarural.com" is agreement not to use "vistarural.com" for any illegal purpose, or purpose prohibited by these terms and conditions, or by other applicable laws and regulations.

1. PRIVACY POLICY

We are serious about protecting the privacy of site users and advertisers with respect and confidentiality and according to the law. "vistarural.com" takes all reasonable steps to ensure that personal information is stored securely and accurately. Please contact us if you have any questions or comments about our policy.

1(a) Travellers

On sending an enquiry to a property owner we will send you an email with a confirmation that your petition has been sent. You may continue to receive at least one email per year. You can always unsubscribe from this service by contacting us by email.

1(b) Data Protection

We use stringent security measures in order to ensure your personal information is safeguarded and prevent disclosure to third parties without your permission. Data storage devices are located in a secure facility with restricted physical access - and firewalls and other measures are used to restrict electronic access. We restrict all data collected to our offices and servers. We will always ask when we need information that identifies you. You may have to co-operate with security checks before we disclose information to you. We will retain your personal data only as long as is necessary for the purposes to which you consent under the Terms and Conditions and this Privacy Policy, or as is required by applicable law, and then we will delete it.

1(c) Cookies

As with many other professional websites, cookies are used to monitor usage and preferences and to facilitate signing in. These are small pieces of data that your browser stores on your computer's hard drive.

2. TERMS AND CONDITIONS FOR ADVERTISERS

2(a) Copyright

The advertiser guarantees that he owns the copyright of the photographic and textual material (the material) posted by him on "vistarural.com, or is authorized by the owner of the copyright to grant "the site owner" permission to use the material. The advertiser grants "the site owner" a perpetual, royalty-free license to use the material for promotional purposes. The advertiser unconditionally indemnifies "the site owner" immediately on demand against any cost, loss, or liability (including legal representation costs) which "the site owner" may incur by any breach of copyright from use of the material. The advertiser understands that photographic or textual material from any part of "vistarural.com" may not be reproduced without permission from the copyright owner.

2(b) Liability

"The site owner" does not guarantee that the operation of "vistarural.com" will be uninterrupted or error free. If an advertiser is victim of fraud, "the site owner" cannot become liable to the advertiser. "The site owner" cannot be held liable to the advertiser for any fraudulent, consequential, or indirect damages, including lost profits, however caused, on any theory of liability, including but not limited to, product liability.

2(c) Design and layout

"The site owner" cannot be held responsible for any loss, or damage, resulting from changes made to the text and photographs submitted by the advertiser or from the design and layout of "vistarural.com". "The site owner" reserves the right to set the final design layout of an advert on "vistarural.com", this includes the right to edit photographs, text or amend layouts. "The site owner" also reserves the right to amend and edit text data entered on the online advertiser database.

2(d) Multiple properties

Only one unit should be represented in an advertisement unless prior permission has been given. A property advertisement on "vistarural.com" belongs to one rental unit, not multiple units, nor should be represented as an example of similar properties. "The site owner" reserves the right to amend or remove any property adverts not in accordance with this policy.

2(e) Termination of an advert

Advertisers can remove their advert from "vistarural.com" before the end of their subscription period, and this will be done as soon as formal notice is received from the subscriber by email, quoting their owner ID and password. Unfortunately, no refunds can be given.

If an advertiser attempts to enter unsuitable material into the database, or repeatedly misuses the on-line system, "the site owner" reserves the right to remove any advertisement and will not be liable for any expense caused.

If "the site owner" receives complaints from users about a specific advertisement misrepresenting a property, or its surroundings, or if "the site owner" repeatedly receives complaints about an owner, then we reserve the right to remove the advertisement and disable the account without notice, and retain payment.

"The site owner" retains the right to refuse any advertisement without having to state a reason.

2(f) Links to external sites and email addresses

Unauthorised links to any website or email address other than "vistarural.com" are prohibited.

"The site owner" will accept reciprocated links to the advertiser's website providing the contents of the site refer exclusively to the advertised property. If an advertiser adds a link or email address without consent, re-adds a link or email address after removal or removes reciprocated links from their website, we reserve the right to cancel their advertisement without refund. "The site owner" accepts no responsibility for the content or legality of external sites.

2(g) Payment

Payment must be made within 48 hours of a new property being registered on "vistarural.com". Online payment by credit or debit card is processed by Cyberpac (Caja de Ahorros y Pensiones de Barcelona) using a fully encrypted SSL secure line for data transmission. Payment by bank transfer is also accepted; however this is usually more costly for the advertiser. Renewal notification will be sent by email.

2(h) Refund policy

No refund or compensation is given for the advertising service offered by "the site owner" be the adverts expired or unexpired.

2(i) Changes to pricing and conditions

"The site owner" reserves the right to modify the rates and conditions without notice. Changes to rates apply immediately for new advertisers and following renewal for existing clients. Special rates can be negotiated for multiple properties.

2(j) Information pack and translation services.

The information packs supplied as part of our advertising package are intended to be used as a translation aid for written communications between advertisers and travellers. "The site owner" cannot be held responsible for any loss, or damage, resulting from use of the content of these packs. Translation of the advert from Spanish to English and vice versa is offered as part of our advertising packages. This offer applies only to new adverts and any subsequent changes that require translation are charged at our standard rates. There is no charge for any changes the advertiser wishes to make in his own language.

3. TERMS AND CONDITIONS OF USE

3(a) Personal use

"vistarural.com" can only be used for research and for making enquiries to advertisers regarding reservations and bookings of holiday rental properties. Any other use of "vistarural.com" is strictly prohibited.

As a traveller you are not charged access, and "vistarural.com" can only be used to contact our advertisers regarding their properties for a possible holiday rental. When an enquiry is sent through "vistarural.com" your email address will be saved in our database and we will send you occasional emails for commercial purposes. At any time you may unsubscribe from this service and your email will be deleted from our database.

3(b) Liability

Use of "vistarural.com" indicates that you agree to release "the site owner" from any loss or damage in connection with any breach of terms and conditions, or any other legal obligation by you and your use of "vistarural.com". "The site owner" cannot be held responsible for any losses or damages you may suffer from the use of "vistarural.com". Therefore, "the site owner" is not obliged to offer any refund or compensation for losses you may have suffered from renting a property from an advertiser on "vistarural.com".

3(c) Accuracy of property information

Accurate property description, prices, bookings and photos are the sole responsibility of the property owner or agent. "vistarural.com" cannot guarantee the accuracy of prices, photos or other information available on www.vistarural.com or www.vistarural.es.

"The site owner" is not liable for misleading photographs, errors, inaccuracies, prices, or claims, made in the information supplied by the owner, or agent, to "vistarural.com".

"vistarual.com" has not checked the veracity of each advertisement and travellers wishing to make their own investigation into the accuracy of any information supplied are advised to do so.

3(d) Copyright

All content and software on "vistarural.com" is protected by copyright. Content may not be copied or used without the prior written approval of "the site owner" or the individual or organization supplying information on "vistarural.com".

4. Our role

"vistarural.com" acts as an intermediary between travellers and advertisers, allowing the publication of advertisements of rental properties, thus enabling travellers looking for a rental property to contact property owners.

We do not act as booking agents, property management company, estate agency or travel agency.
